Do you market, import, or distribute construction products or materials, furnishing components, or DIY and gardening items in your own brand name ?

If so, you must comply with the Extended Producer Responsibility (EPR) scheme and make sure you are compliant with a government-approved PRO like Valobat.

    Regulations and requirements

    What is EPR (Extended Producer Responsibility)?

    Extended Producer Responsibility (EPR) requires companies placing products and materials on the French market to manage and finance their products’ end-of-life. To comply, marketers can pool their efforts by joining a state-approved PRO and paying eco-contributions.

    Eco-contributions not only allow the PRO to set up your entire collection and waste treatment network but also offer baseline services to improve reuse practices, support members with eco-friendly design initiatives, or even help develop new outlets for certain waste-generating products and materials.

    Which products are covered by the regulations?

    In France, about twenty EPR schemes exist. Valobat covers the following products under its EPR schemes:

    EPR for Construction Products and Materials (PMCB)

    Covers all products intended to be incorporated, assembled, used, or installed on a construction site (excluding public works)

    EPR for Furnishing Components (DEA)

    Furniture and furnishing components for personal or commercial use, including custom-made fittings

    EPR for DIY and Gardening Items (ABJ)

    DIY equipment and products and materials intended for garden maintenance and landscaping

    EPR for Professional Packaging (EPRO)

    While joining a PRO is an essential first step toward compliance, it is not enough. Here are the next steps in your life as a member:

    Declaring your market placements annually

    Each year, you are invited to log in to your personal space to declare your market placements.

    Declaring with Valobat is simple!
    – Only one declaration per year (between January and March)
    – Simplified schemes for small-scale marketers
    – Support at every stage

    Integrating the eco-contribution into the your products’ sales price:

    Depending on the EPR scheme (product universe), rules regarding the integration and transparency of the eco-contribution differ:

    Building EPR (PMCB):
    Integration is required; transparency is recommended

    Furnishing EPR (DEA):
    Integration and transparency required on sales documents (catalogues, invoices, sales sites, etc.)

    DIY & Gardening Items EPR (ABJ):
    Integration and transparency are not required

    The TRIMAN labelling requirement

    Whether you market building products, furnishing elements, or DIY and gardening items, you must follow sorting information labelling requirements on your products.

    This labelling informs consumers, whether individuals or professionals, abut how to dispose of the product.

    Building EPR: Are you required to label your products with TRIMAN?

    To help you identify which, in any, of your products fall under TRIMAN labelling requirements, Valobat has developed a TRIMAN diagnostic tool. Answer a few questions, to find out if labelling is required on a given product and whether you are responsible for doing so.

    Declaring reused professional packaging

    Do you place more than 10,000 units of packaged products on the market per year? You are therefore required to make an annual declaration of your packaging data.

    This regulatory provision implemented by ADEME (France’s green transition agency) and the French Reuse Observatory is a temporary solution ahead of the future Extended Producer Responsibility for Professional Packaging (EPR EPro).     The Waste Prevention and Eco-design Plan

    The AGEC law requires marketers subject to EPRs to have a Prevention and Eco-design Plan.

    Its objective: to allow you to formalize and share the actions you plan to implement over the next 5 years to reduce the environmental impact of your products (eco-design, use of recycled materials, improvement of recyclability, etc.)

    To establish your plan, Valobat offers 3 options:
