Construction EPR, from the marketers’ perspective

Since 2022, marketers of Construction Products and Materials (PMCB) in the building sector have been required to ensure the end-of-life management of their waste within the framework of the EPR scheme.

Which marketers are affected by the Construction EPR scheme?

  • Industrial manufacturers: all companies whose activity is dedicated, at least in part, to manufacturing materials, products, components, and equipment for construction, either industrially or artisanally
  • Distributors marketing products using their own brands
  • Importers of construction products and materials intended for sale to project owners or construction companies… (NB: Distributors marketing foreign products are considered producers by virtue of their imports)

Which product categories are covered
by the Construction EPR scheme?

All products and materials manufactured to be incorporated, assembled, used, or installed on construction sites. They are divided into two main categories: inert and non-inert.

Category 1

Construction products and materials consisting predominantly by mass of minerals containing neither glass, mineral wool, nor plaster, falling within the following families:

a) Concrete and mortar or one of their components

b) Lime

c) Limestone, granite, sandstone, and lava

d) Terracotta or raw earth

e) Slate

f) Bituminous mixture or one of its components, excluding bituminous membranes

g) Aggregate, except those indicated in a) and d)

h) Ceramics

i) Mineral-based construction products and materials not mentioned in another family in this category

Category 2

Other construction products and materials falling within the following families:

a) Construction products and materials consisting mainly by mass of metal, except those indicated in d)

b) Construction products and materials consisting mainly by mass of wood, except those indicated in d)

c) Mortars, coatings, paints, varnishes, resins, preparation and application products, including their containers, other than those mentioned in 7° of Article L. 541-10-1

d) Joinery containing glass, glazed walls, and related construction products

e) Plaster-based construction products and materials except those mentioned in c)

f) Construction products and materials consisting mainly by mass of plastic

g) Bituminous membrane-based construction products and materials

h) Glass wool-based construction products and materials

i) Rock wool-based construction products and materials

j) Plant- or animal-based construction products or other materials not mentioned in another family in this category

Important: Construction products and materials intended for the public works sector (roads, bridges, etc.) are excluded from these requirements.

What requirements for marketers?

Under the Construction, Furnishing, and DIY & Gardening EPR schemes, producers are responsible for managing their products at the end of their life, whether through collection, recycling, or treatment.

To manage this stage in their products’ life, producers can either handle this internally, setting up appropriate systems that meet the EPR specifications, or collectively create structures, such as PROs, which will then handle the requirements for them. Producers pay these PROs a financial contribution (eco-contribution) for their service, but remain involved at every stage, from designing eco-friendly products to end-of-life treatment, including collection, reuse, and recycling.

Businesses subject to the Construction, Furnishing, and DIY & Gardening EPR schemes are also required to display the TRIMAN marking to provide the consumer, whether an individual or a professional, with the sorting information they need to properly dispose of the product.
